By purchasing a Frank Peters artwork you are agreeing to the terms and conditions as listed below. Frank Peters is registered with the Netherlands Chamber of Commerce in Rotterdam the Netherlands, Dordrecht division, registration number 24406690.

Article 1: Offer and Acceptance

The agreement between the customer and the photographer comes into effect when the customer accepts the photographers offer through payment of an invoice provided by the photographer.

 

Article 2: Purchase Agreement

The customer will receive a unique fine art print or a fine art print from a limited edition, with certificate of authenticity, signature and date. In the case that the customer receives a unique fine art print, the photographer will never sell or print the photo as an artwork again, will never use the image for commercial reasons and the customer will get a 100% guarantee that they are the sole owner of the unique fine art print, the only exception being the artists own copy which will only be used for exhibitions. This fine art print is not destined for sale and will therefore not be signed, dated or accompanied by a certificate of authenticity. In the case of limited edition fine art prints the photographer will not print or sell the artwork beyond the full edition number, the only exception being the artists own copy which will only be used for exhibitions. Article 3.1: Copyright Unique Fine Art Prints

In the case of unique fine art prints the photographer retains the copyright of the image and the right to use the image for personal publicity and commercial purpose. This includes but is not limited to the use of social media and other media, with the restriction that only low resolution images will be used and the size of the image will be limited to that normally used in newspapers, magazines, books, websites, television etc. These images will not be printed as artwork or sold as artwork and are therefore not be accompanied by certificate of authenticity, date or signature. This is only the case for the unique fine art prints and those from limited editions.

 

Article 3.2 Copyright of Limited Edition Fine Art Prints

In the case of limited edition fine art prints the photographer retains the copyright of the image and the right to use the image for personal publicity and commercial purpose. This includes but is not limited to the use of social media and other media, with the restriction that only low resolution images will be used and the size of the image will be limited to that normally used in newspapers, magazines, books, websites, television etc. These images will not be printed as artwork or sold as artwork and are therefore not be accompanied by certificate of authenticity, date or signature. This is only the case for the unique fine art prints and those from limited editions.

 

Article 4:Reproductions

The customer is permitted to take photos and videos etc of the artwork for promotional reasons. This includes, but is not limited to, their use on social media and in other media forms such as magazines, newspapers, books, websites, television etc, but with the restriction that low resolution images will be used with dimensions not exceeding those normally used in newspapers, magazines, books, websites, television etc. The customer is not permitted to print, copy, reproduce or in any other way manufacture high quality images derived from the original artwork, for distribution or sale.

Article 5: Delivery and Liability

The photographer will be responsible for delivery of an intact copy of the fine art print to the address provided by the customer. The photographer will accept liability for damages occurring prior to delivery. After delivery, damages are the customer’s liability. The photographer will also be liable for defects that become apparent after delivery, given the defects can be attributed to inconsistencies during the production of the print. The customer is liable for defects caused by the customer.

Article 6: Tax and Legal Regulations

Prices of products and services on this website are displayed in Euros. Dutch taxes and laws apply to all displayed products and services.

 

Article 7: Order Cancellation

Orders can be cancelled within two days after purchase without cost. After this, a cancellation fee of 50% of the purchase price will apply.
